The New York Times reports this morning [1] on the latest strategy of the opponents of meaningful health care reform, the invocation of states rights.

The Times reports that lawmakers in 10 states have introduced constitutional amendments prohibiting the federal government from mandating health insurance coverage.

The American Legislative Exchange Council, the right-wing organization of state lawmakers, is helping spearhead the states rights movement to resist health care reform.

The Times quotes Minnestoa Rep. Tom Emmer, who is leading the charge in his state for a constitutional amendment to defy the federal government.

All I’m trying to do is protect the individual’s right to make health care decisions. I just don’t want the government getting between my decisions with my doctors.

Wake Forest law professor Mark Hall told the Times that there’s no way the efforts would hold up in court and that’s it mostly an act of defiance. 

That always true with the states right crowd, whether they are standing in the schooolhouse door preventing African-American kids from entering or standing on the hosital steps trying to prevent the uninsured from getting help.
