A little perspective on recent health care rulings

Those touting recent decisions by conservative federal judges to invalidate the new health care law as the death knell for reform would do well to remember a little U.S. history. As Ian Millhiser pointed out yesterday at The Wonk Room , lower courts also struck down Social Security, the Voting Rights Act, the Civil Rights Act and the minimum wage before the Supreme Court ultimately upheld them.
Millhiser notes that while it’s fine for the right to crow about the most recent decision by a judge in Florida,
…the truth is that lower courts routinely strike down landmark legislation before that law is eventually upheld — and there is every reason to believe that the Supreme Court will do the same here .”
