The Pennsylvania Attorney General, Kathleen Kane, is expected to announce today that her office will not defend the state in the ACLU action filed yesterday challenging that state’s ban on same-sex marriage, philly.com is reporting.
California officials — including Govs. Arnold Schwarzenegger and Jerry Brown — did the same there when they declined to defend Proposition 8 in court, as the state’s current Attorney General, Kamala Harris, has likewise done.
The ACLU action in Pennsylvania mirrors a challenge to North Carolina’s ban announced on Tuesday.
