Another important Cooper v. Berger/Moore lawsuit is in court this morning

A three-judge panel today will hear a lawsuit similar to one they already decided [1] a few months back that involves Gov. Roy Cooper and legislative leaders.

Instead of appealing the judges’ findings that it was unconstitutional for lawmakers to merge the State Ethics Commission with the State Board of Elections, the Republican-led General Assembly wrote a similar bill, Senate Bill 68 [2], and Cooper again sued them over it.

Cooper cites the Separation of Powers clause in the Constitution as grounds for the 29-page lawsuit [3], as well as the non-delegation doctrine.

Legislators say they re-wrote the law to address the judges’ concerns in their initial ruling against a similar bill.
